Is your spouse named as beneficiary on your life insurance?

🌙

If your spouse is the named beneficiary, the payout goes directly to her outside your estate. This affects how the farā'iḍ shares are calculated on your remaining assets.

الفرائض

Automatic Islamic Share Calculation

Your will expresses the exact Quranic shares as percentages, calculated from your specific family composition. Here's an example with wife, son, daughter, father, and mother all surviving.

Heir Arabic Term Quranic Basis Share Example on NZ$500,000
Wife الزوجة Qur'an 4:12 — 1/8 with children NZ$62,500
Father الأب Qur'an 4:11 — 1/6 fixed NZ$83,350
Mother الأم Qur'an 4:11 — 1/6 fixed NZ$83,350
Son الابن Qur'an 4:11 — Residuary 2:1 NZ$180,550
Daughter البنت Qur'an 4:11 — Residuary 2:1 NZ$90,300
Charity (Wasiyya) الوصية Taken first — up to 1/3 of net estate Your choice

* Shares are calculated from your distributable estate after debts, funeral expenses, and wasiyya. Exact calculations depend on your family composition and assets.

Assalamu Alaikum! I'm your Islamic estate planning assistant. Based on your profile — wife, one son, one daughter, both parents, and a home in Auckland — I've calculated your farā'iḍ shares. What would you like to understand better?
👤
What happens to my KiwiSaver if I don't have a will?
🤖
Great question. KiwiSaver doesn't allow a binding beneficiary nomination in NZ law — it forms part of your estate. Without a will, it's distributed under the Administration Act 1969 intestacy rules, which don't apply farā'iḍ. Your wife would receive $155,000 + 1/3, with children sharing the rest equally — not Islamically. A will is the only way to ensure your KiwiSaver is distributed per Qur'an 4:11. Shall I explain how to structure this?

Questions

Frequently asked questions

Wasiyya.nz generates draft documents that comply with the Wills Act 2007 in structure and content. However, a will is only legally valid once properly executed — signed by you and two witnesses who are not beneficiaries, all present simultaneously. We provide detailed signing instructions and strongly recommend having a NZ solicitor witness the signing.
Yes. The wizard asks for your preferred madhhab. Shafi'i and Hanafi schools agree on the core farā'iḍ shares (Qur'an 4:11–12) for most family compositions. Where differences exist (e.g., certain grandfather/grandmother situations), the AI assistant will flag this and recommend consulting a scholar.
If your home is held as joint tenants, it passes automatically to your wife by right of survivorship — it does NOT go through your will or farā'iḍ. The wizard covers this and explains your options (severing the joint tenancy to hold as tenants in common so your share passes through the estate). This is one of the most important questions in NZ Islamic estate planning.
All your personal information is encrypted at rest using AWS KMS customer-managed keys and in transit with TLS 1.3. Data is stored in the AWS ap-southeast-2 (Sydney) region. We comply with the NZ Privacy Act 2020, including your right to access, correct, and erase your data. We do not sell or share your data with any third party.
Yes. Update your profile and wizard answers at any time, then regenerate your documents. Note that under the Wills Act 2007, marriage automatically revokes a previous will — so if you marry after generating your first will, you must generate a new one. We'll remind you of this.
Yes. The wizard includes a conditional Pakistan/overseas property section (unlocked if you answer yes to that question). It covers NADRA succession certificates, wirasat mutation, power of attorney guidance, and Roshan Digital Account repatriation. The generated documents include a cross-border estate clause and a detailed reference section on the Pakistani succession process.
The Wasiyya Supplement (Letter of Wishes) is a companion document to your will. It's not legally binding, but it explains the Islamic reasoning behind your distribution choices — especially the 2:1 son/daughter ratio. Under the Family Protection Act 1955, family members can challenge your will within 12 months of probate. A well-drafted Wasiyya Supplement is your strongest protection against such challenges, as it demonstrates your testamentary intent based on sincere religious belief.
